These Terms of Service ("Terms") govern your use of themepages.com and its subdomains (the "Site"), including any application forms, scheduling pages, videos, and content on the Site. The Site is operated by Media Monopoly, LLC ("ThemePages," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Enrollment in the Theme Page Accelerator or any other paid program is governed by a separate enrollment agreement presented at the time of purchase. Where these Terms and an enrollment agreement conflict, the enrollment agreement controls for that program.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site, submit an application, or book a call. By using the Site you represent that you meet these requirements.

2. What the Site is

The Site provides information about ThemePages and the Theme Page Accelerator, educational content, an application form, and the ability to schedule a call with us. Submitting an application or booking a call does not create a coaching relationship, guarantee acceptance into any program, or obligate either of us to enter into a program agreement. We may decline any application at our discretion.

3. Applications and calls

When you apply or book a call you agree to provide accurate, current, and complete information. Calls are scheduled through a third-party scheduling tool and held on a third-party video platform, each subject to its own terms. We may record calls for training and quality purposes; if we do, we will tell you at the start of the call. If you cannot attend a scheduled call, please reschedule or cancel through the link in your confirmation rather than not attending.

4. Communications and text messaging

By providing your email address you agree to receive emails from us about your application, your call, and our programs. You can unsubscribe from marketing emails at any time using the link in any email.

By providing your mobile number and opting in when booking, you consent to receive text messages from ThemePages, including appointment confirmations and reminders, follow-up messages about your call, and occasional messages about our programs. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out; reply HELP for help. Consent to receive texts is not a condition of purchasing anything. See our Privacy Policy for how we handle your mobile information — in short, we do not share it with third parties for their marketing.

5. Educational content; no guarantees

Everything on the Site — videos, articles, emails, examples, and figures — is provided for educational and informational purposes only. It reflects our own experience operating Instagram theme pages and is not financial, legal, tax, or professional advice.

We make no guarantee that you will earn any money, grow any audience, or achieve any particular result by using the Site, watching our content, or enrolling in a program. Any figures we share about our own pages, revenue, or follower counts are our actual results; they are not typical, they are not a promise, and they should not be taken as an indication of what you will achieve. Results depend on your effort, skill, market conditions, platform changes, and factors outside anyone's control, and building a media asset carries the risk of earning nothing. Where a program includes a guarantee, its terms are stated in the enrollment agreement for that program and nowhere else.

Instagram, Meta, and the other platforms discussed on the Site are not affiliated with, and do not endorse, ThemePages. Their rules change, and nothing on the Site guarantees how any platform will treat your content or account.

6. Intellectual property

The Site and everything on it — text, videos, graphics, logos, the ThemePages name and wordmark, course materials, templates, and the structure and expression of our methods — are owned by Media Monopoly, LLC or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to view the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, publicly display, create derivative works from, sell, or otherwise exploit any Site content without our prior written permission, and you may not use our name or marks to suggest an affiliation or endorsement.

7. Acceptable use

You agree not to: use the Site for any unlawful purpose; submit false information; scrape, crawl, or harvest data from the Site; interfere with or disrupt the Site or its infrastructure; attempt to gain unauthorized access to any system or account; upload malicious code; impersonate any person; or use the Site to send unsolicited communications. We may suspend or block access for any violation.

8. Third-party services

The Site relies on third-party services, including Framer (hosting), Typeform (applications), Calendly (scheduling), Zoom (calls), GoHighLevel (email and SMS), Skool (course delivery), and payment processors. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, content, or practices of any third-party service or any site we link to.

9. Testimonials and examples

If we present results, statements, or examples from clients or from our own pages, they are individual experiences and are not representative of what any other person will achieve. We do not pay for testimonials. Where an example is illustrative rather than a real account, we will say so.

10. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY CONTENT IS COMPLETE OR CURRENT.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MEDIA MONOPOLY, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY RELATING TO A PAID PROGRAM IS GOVERNED BY THAT PROGRAM'S ENROLLMENT AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Media Monopoly, LLC and its members, officers, employees, contractors, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Governing law and disputes

These Terms are governed by the laws of the State of Indiana and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at johnny@themepages.com and make a good-faith attempt to resolve the dispute informally for at least thirty (30) days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in United states, Indiana, and you consent to their jurisdiction. You and ThemePages each waive any right to a jury trial and to participate in a class action to the extent permitted by law.

14. Changes to the Site and these Terms

We may change the Site, or these Terms, at any time. The effective date at the top shows when the Terms last changed. Continued use of the Site after a change means you accept the revised Terms.

15. General

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any enrollment agreement you sign, are the entire agreement between you and us regarding the Site.
